"Montie 3" case adjourned sine die

The Supreme Court has ordered parties in the case before it seeking the nullification of the pardon former president Mahama granted to the ‘Montie 3’ to file their legal arguments independently and simultaneously within 21 days.

A seven member panel of judges headed by Justice Mrs. Sophia Adinyera  also said if there is any reply it should be done orally.  

Counsel for the defendants, Dr Ernest Owusu Dapaah said the memorandum of issues was jointly filed on the 20th of this month and prayed the court to adopt same. 

Justice Sophia Adinyera said the the court has adopted their memorandum of issues.

Some three persons, Nana Asante Bediatuo, Elipklim Agbemeva and one Alfred Yeboah are in court to challenge the pardon of the ‘Montie 3 granted by former president John Mahama.

The three ex-convicts, Alistair Nelson, Godwin Ako Gunn and Salifu Masse were sentenced to three months of imprisonment for threatening to kill some judges and rape the then chief justice, Theodora Wood on Montie FM in 2016.

The three were released after serving three weeks of the sentence following pressure from some NDC members.

Mr. Asante Bediatuo and others are in court demanding the revocation of the pardon for the three to go back to jail and serve the remaining sentence. 

They also want an interpretation of the law as to whether the pardon as the president of the land has to do can be extended to giving remission to those jailed for criminal contempt. 

The case has been adjourned sine die.
